These Terms & Conditions ("Terms") govern your use of thewarmcraft.ie and thewarmcraft.com (the "Site") and any purchase you make from us. By placing an order, you agree to be bound by these Terms. Please read them carefully before ordering.

1. Who We Are

The Warm Craft is operated by Alan Ederson Da Silva, trading as The Warm Craft, a sole trader registered in Ireland.

2. Our Products

All products sold by The Warm Craft are designed and 3D-printed in-house. We make every effort to ensure product descriptions, images, and pricing on the Site are accurate. However:

Colours may vary slightly from what is shown on screen due to display settings and the nature of the printing filament used
As each item is individually printed, minor variations in texture or finish between units of the same product are normal and are not considered defects
We reserve the right to correct any errors in pricing or product descriptions, and to update, discontinue, or limit quantities of products at any time

3. Orders and Acceptance

Placing an order on our Site constitutes an offer to purchase. A contract is only formed once we confirm your order by email. We reserve the right to refuse or cancel an order at our discretion — for example, if a product is out of stock, if there is a pricing error, or if we suspect fraudulent activity — in which case we will notify you and issue a full refund.

4. Pricing and Payment

All prices are listed in euro (€) and, as we are not currently VAT-registered, do not include VAT. Payment is processed securely through Shopify Payments and/or our third-party payment processor at the time of order. We do not store your full payment card details.

5. Delivery

Delivery times, costs, and destinations are set out in our Shipping Policy, which forms part of these Terms. Estimated delivery times are not guaranteed and may be affected by factors outside our control.

6. Your Right to Cancel

If you are a consumer shopping from within the EU, you have the right to cancel your order within 14 days of receipt without giving a reason, in accordance with the EU Consumer Rights Directive (2011/83/EU). Full details of this right, and the process for returns and refunds, are set out in our Refund & Returns Policy, which forms part of these Terms.

In line with Article 16(c) of the EU Consumer Rights Directive, this 14-day right does not apply to goods made to your specifications or clearly personalised, as further explained in our Refund & Returns Policy.

7. Legal Guarantee

As a consumer in the EU, you are entitled to a minimum 2-year legal guarantee that goods are as described, fit for purpose, and of satisfactory quality, under the EU Sale of Goods Directive (2019/771) as implemented in Ireland. See our Refund & Returns Policy for further details.

8. Intellectual Property

All designs, product images, text, logos, and content on the Site are the property of The Warm Craft, unless otherwise stated, and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our designs or content without our prior written permission. Purchasing a physical product does not grant you rights to reproduce or resell the underlying design.

9. Limitation of Liability

To the fullest extent permitted by law, The Warm Craft shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or products purchased, except where such liability cannot be excluded under Irish or EU law (including for death, personal injury, or defective products under applicable consumer protection legislation). Nothing in these Terms limits or excludes your statutory rights as a consumer.

10. Privacy and Cookies

Your use of the Site and any personal data you provide is governed by our Privacy Policy and Cookie Policy, which form part of these Terms and explain how we collect, use, and protect your data in accordance with the GDPR.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

12. Online Dispute Resolution

If you are an EU consumer and are unable to resolve a complaint with us directly, you may use the European Commission's Online Dispute Resolution (ODR) platform to seek an out-of-court resolution: ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business practices or legal requirements. Any changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
